By signing up to any of the programs, courses or membership site advertised on the Too Old To Tumble™ website, you are acknowledging that you have read, agree to and accept all of the terms and conditions contained in this Agreement. We may amend this Agreement at any time. You may request to view the amended version by using the form on our contact page.
You are responsible for the full payment of our fees relating to the program, challenge or membership that you wish to purchase or subscribe to, regardless of whether you actually attend the live trainings (when provided as part of the program, membership or challenge) or complete the Home Study assignments, and regardless of whether you have selected to pay in full upfront or have agreed to a payment plan.
To further clarify, all monthly payments must be paid on a timely basis. It is your responsibility to ensure you have the means to pay for the program, challenge or membership that you are purchasing and that this is not placing you or your family under undue financial strain.
We are committed to providing all our Customers with a positive and uplifting learning experience and we will endeavour to carry out the live components of our programs and challenges in a friendly and non-judgmental manner.
We expect you to do the same. Should you become disruptive or disrespectful of any program, challenge or membership offered by Too Old To Tumble or fellow participants we reserve the right to terminate this agreement and limit, suspend or terminate your participation in our private Facebook Groups, membership site or courses and challenges without refund or cancellation of your remaining monthly payments.
We respect your privacy, your confidential and proprietary information ideas, plans and trade secrets and we must insist that in return you respect the privacy, confidential and proprietary information ideas, plans and trade secrets of Too Old To Tumble™ and your fellow members and program or challenge participants.
By purchasing one of our programs, challenges or membership package you agree:
(1) not to infringe any copyright, patent, trademark, trade secret or other intellectual property rights of Too Old To Tumble™ and/or fellow participants;
(2) that any Confidential Information shared by Too Old To Tumble™ and/or fellow participants belongs solely and exclusively to the individual that discloses it and must not be shared with anyone outside of the program, challenges or membership site you are participating in (this includes external forums and social media);
(3) all materials and information provided to you by Too Old To Tumble™ are confidential and our proprietary intellectual property, being solely and exclusive to Too Old To Tumble™;
(4) the reproduction, distribution and sale of these materials by anyone but Too Old To Tumble™ is strictly prohibited.
We have made every effort to accurately represent the potential for improved fitness, weight/fat loss and reshaping of our courses and challenges. However, we cannot guarantee that you will achieve the full potential of the results that are possible when following our system.
Your success depends on many factors, including your background, your body’s inherent responsiveness to diet and exercise, your dedication to the Program of your choice, the strength of your desire to implement changes, your willingness to see the program and challenges through to the end and your motivation to succeed.
By purchasing our programs, challenges or membership package you acknowledge that as with any other self improvement investment, there is an inherent risk of loss of capital and there is no guarantee that you will achieve your weight/fat loss and reshaping goals as a result of your participation in any of our programs and challenges.
Moreover, there is no way that we can verify your conduct outside of your active participation to a program or challenge and we have to trust that you are being truthful at all times when discussing your adherence to the program or challenge.
For this reason we do not offer any refunds on any of our programs, challenges or membership package nor we will issue any partial refunds if you miss any of the live sessions being part of your chosen program or challenge (we will however endeavour to record these and make the recordings available to you as soon as possible after the event).
You will be able to choose the dates and times of our calls when working with us on a 1-2-1 basis and you will be informed of the date and time of the weekly/fortnightly/monthly calls when working with us as part of a group. It is entirely your responsibility to show up on time and we are under no obligation to offer a replacement session should you fail to show up.
More specifically, when working with us on a 1-2-1 basis, at the end of each call, we will book our next live session for a mutually convenient time and if you need to cancel or postpone any of the calls we ask that you give us at least 24hrs notice. Failure to do so will result in you losing that session and being unable to claim a refund for it.
Please be aware that there may be additional Rules of Engagement for each specific program, challenge or membership so always refer to those prior to making your purchases.
